Smoking in closes

Does anyone know the legality of this, if a neighbour smokes outside your door and the smell comes in strongly?

I doubt it's any less legal than overpowering cooking smells. You'll almost certainly find a solicitor who'll assure you that you have an airtight case and we seek to relieve you of not insubstantial sums of money to pursue it.

Have you talked to the neighbour about this?

At this time there is nothing to prevent your neighbour smoking in the close - as usually closes are 'private communal property.' This point has been raised previously on this forum or another and it was a legal eagle who provided the information. I've done a search but as per usual.....

Kirsty, is it my close you are talking about by any chance?

Got a downstairs neighbour who smokes on the half landing. I can smell it coming in to my flat on the floor above, in to the kitchen, the lounge etc. I had a word with him, and he stopped for a week or so. Then back at it.

The cheeky bastard had the gall to do it in front of me while I was cleaning the close! And he doesnt close the window, so rain and leaves come in too.

VERY ANNOYING.

I have a neighbour who does this too, the bastards. I don't see why it's acceptable. They don't smoke in their own flat because they don't want it to smell of smoke, but they're happy to fill the close with smoke, meaning that I get a faceful of it when I open the door to the postman, and I have to walk through it when going out/coming home?

Why is this more acceptable than smoking in a bus shelter (where the wind will carry the smoke away), which is illegal?

Bus shelter could be considered 'public space' but a communal close is not - it is a private dwelling.

Does anyone think there's any reason why all the owners of flats in tenement close couldn't get together and agree that the communal areas should be smoke free if they so wished?

Does anyone know why nobody has any tolerance any more? Wake up and smell the diesel fumes. We're all going underground or up in smoke someday. Smoking in the close ffs! :x

I'd ban smoking 100%. Absolutely everywhere and to hang with the consequences for income from duty.

I'd also ban diesel (and petrol) engines from being used in enclosed spaces.
